It should be easy to understand laws so that we can follow them accordingly, so we want to break down the legal terminology behind the 2018 Farm Bill and all its addendums thus far.

Let’s get into it. To reiterate the Farm Bill’s mandated provisions, the August 2020 amendments to the 2018 Farm Bill included additional rules. This update states that the “DEA’s regulatory power over any plant with less 0.3% THC on a dry basis and any derivatives below the 0.3% limit is being removed …”

This “THC content” can be defined as and not.

These were the four changes:

  1. Schedule I has been modified to allow extracts with a higher than 0.3% Delta-9THC per dry weight to fall under the definition of “Marihuana Extract”. This means that extracts from marijuana or hemp must contain less than 0.3% Delta-9 THC to remain legal.
  2. The Controlled Substances Act has been completely removed from Epidiolex and any generics that the FDA might approve in the future. This medication has been proven to be effective in treating rare forms of epilepsy in childhood.
  3. Epidiolex was removed from the import and export permit lists.
  4. Finally, the definition of “Tetrahydrocannabinols” was modified in the Schedule I section of the Schedule of Controlled Substances. This definition was amended to include “any material or compound, mixture, preparation, or preparation that falls within hemp’s definition” as defined by the 2018 Farm Bill.

Broken down means:

  • These changes have not affected the FDA’s jurisdiction over marijuana and cannabis-derived products.
  • Any product containing more than 0.3% Delta-9THC is considered a controlled substance.
  • Any hemp or cannabis product containing more than 0.3% Delta-9-THC is considered to be a controlled substance.
  • Any synthetically-derived THC is a controlled substance — the THC content does not matter.
  • THC found in cannabis plants, regardless of whether they are hemp or marijuana, does not count as a controlled substance.

What does this mean for Delta-8? Is this a form of legal THC?

Technically, vape carts containing Delta 8 THC can be considered controlled substances if they are made from high-quality hemp. It is legal if the product is made from hemp and contains 0.3% Delta-9 or less THC.

Although Delta-8 was included to the schedule, it is unlikely that this route would have been intended by the government to legalize THC. The law could change in the future, but for now, Delta 8 vape cartridges are still the best choice as psychoactive cannabis oil. They provide a high without any paranoia or other stress-inducing side effects.
