The 2018 Farm Bill opens up the possibility of hemp-based THC.
It’s 2022, but the 2018 Farm Bill is still shaking things up in the U.S. cannabis market. In the years since the bill came into effect, products rich in hemp-derived CBD, delta-8 THC, delta-10 THC, and other emerging cannabinoids have become available to the masses thanks to enterprising individuals and companies in the booming hemp sector.
Some brands in the hemp industry have recently taken advantage of the Farm Bill’s flexibility to create products that provide a traditional THC experience for their customers.
Are Delta-9 THC Products Legal?
The short answer is that certain products that contain delta-9 THC can be legal! It’s more complicated than that. These products are based on their individual THC levels and the source of THC.
The 2014 Farm Bill allowed very limited cultivation of industrial hemp to support research programs. The 2018 Farm Bill, also known as the Agriculture Improvement Act of 2018, significantly expanded this. It legalized the cultivation of hemp at the federal level. Anyone with the right land, knowledge, and means to start a hemp farming operation can do so. The law also stated that hemp must be less than 0.3% THC per dry weight. This is to distinguish industrial hemp (often used for rope and other textiles) from cannabis plants specifically cultivated with the purpose of THC delivery.
Hemp, like its potent cousins, is a member of the cannabis plant family and contains a range of cannabinoids (the active chemical compound found in cannabis plants). Researchers and cultivators were able to study and process hemp more freely after the Farm Bill was passed.
Hemp-based CBD products of any description quickly became popular. Soon, products with delta-8 THC–cannabinoids that are found in trace amounts in hemp or cannabis plants, as well as products with delta-10 THC-cannabinoids, were also available. These can be synthesized using CBD isolate to produce products that have the unique effects of these cannabinoids. Many producers are now opting to eliminate delta-9 THC from their extracts or to reduce its role in full-spectrum products. Federally legal hemp products must contain less than 0.3% delta-9THC per dry weight.
The cannabinoid delta-9 THC, which is what most cannabis users know and love, is responsible for the euphoric high associated with smoking marijuana or other THC products in medical or recreational legal states such as edibles or vape cartridges. Although it is legal in certain states, it is not yet legal at the federal level.
Some hemp producers like Redempeorcbd.com have been able to use the 0.3% delta-9-THC restriction to their advantage. They can offer products with noticeable amounts of delta-9-THC to any national market as long as their hemp products comply with this ratio requirement.
